1. Acceptance of Terms

By accessing or using bubullet ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, and contributors of content.

2. Description of Service

bubullet is a couples' journal application that provides:

  • Personal and shared journal entries
  • Mood tracking and visualization
  • AI-powered relationship insights
  • Date idea suggestions
  • Calendar and bucket list features
  • Photo memories for completed dates

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration

To use the Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Ownership

You retain ownership of all content you create using the Service, including journal entries, photos, and other materials ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content as necessary to provide the Service.

4.2 Responsibility

You are solely responsible for your User Content. You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Violates the privacy of others
  • Is spam or unauthorized advertising

4.3 Sharing with Partner

When you link with a partner, certain content may be shared with them as part of the Service's core functionality. You are responsible for ensuring you have the right to share any content with your partner.

5. AI Features

The Service includes AI-powered features that analyze your content to provide insights and suggestions. By using these features, you acknowledge that:

  • AI-generated content is for informational purposes only
  • AI suggestions should not replace professional advice (medical, legal, psychological)
  • AI features require sending data to third-party AI providers
  • You can disable AI features in settings at any time

6. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without permission
  • Reverse engineer or attempt to extract source code
  • Use the Service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Sell, resell, or exploit the Service commercially without authorization

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by bubullet and are protected by international copyright, trademark, and other intellectual property laws.

"bubullet" and our logo are trademarks. You may not use our trademarks without prior written consent.

8. Third-Party Services

The Service may contain links to or integrations with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUBULLET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless bubullet and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including without limitation if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the app or sending you an email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Brazil.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
